The Government has just issued Decree No. 100/2019 / ND-CP stipulating sanctions against administrative violations in the field of road and rail transport, effective from January 1, 2020, replacing Decree No. 46/2016 / ND-CP dated May 26, 2016 of the Government.
Accordingly, the basic new contents of Decree No. 100/2019 / ND-CP are as follows.
Amend some contents to comply with the provisions of the 2017 Railway Law, the Law on Prevention and Control of Alcohol and Beer Harm in 2019, and (new) documents guiding the implementation of the Road Traffic Law, meeting practical requirements of traffic order and safety. From January 1, 2020, the Law on Prevention and Control of Alcohol and Beer Effects has officially taken effect and tightened the regulations on the use, trading and trading of alcoholic beverages.
Accordingly, regardless of drivers of road vehicles (cars, tractors, motorcycles, electric motorcycles, motorcycles) and rudimentary road vehicles (bicycles, cyclos, wheelchairs , trailers, etc.) are not allowed to drink alcohol while traveling on the road.
The current law allows drivers of vehicles to drive despite having alcohol content, in which the motorcycle is allowed to be below 50 milligrams per 100 milliliters of blood or 0.25 milligrams per liter of gas. As such, the new regulation will completely ban and no longer prescribe an alcohol content framework.
The Law on Prevention and Control of Harms from Alcohol and Beer is strictly prohibited from instigating, inciting, inducing or forcing others to drink alcohol or beer.
In addition, the law prohibits cadres, civil servants, public employees, and employees in agencies, organizations, officers, non-commissioned officers, professional soldiers, soldiers, and people working in the people’s armed forces. , pupils and students drink wine and beer right before, during working hours, study and take breaks between working and studying time.
The law prohibits advertisements for alcohol with an alcohol content of 15 degrees or higher.
